After a DOT drug or alcohol violation, federal regulations require you to complete an evaluation with a qualified SAP before you can return to safety-sensitive work. The SAP will assess your situation, determine whether you need education, treatment, or both, and develop a plan tailored to your needs. Step 2: Complete Treatment & Education

Once your SAP prescribes a treatment or education program, you must complete it in full before moving forward. This may include counseling sessions, substance abuse education courses, or a structured treatment program — depending on your evaluation results. After completing the program, you’ll return to your SAP for a follow-up evaluation. The SAP will determine whether you’ve successfully met the requirements and are eligible to proceed to the return-to-duty test. Directly Observed Drug & Alcohol Testing
Per 49 CFR Part 382, return-to-duty testing is required before a driver can resume safety-sensitive functions. All DOT return-to-duty drug tests are conducted under direct observation as required by 49 CFR Part 40. We schedule your test at one of 20,000+ SAMHSA-certified collection sites nationwide. Drug testing uses the standard DOT 5-panel urine test ($69), and alcohol testing uses an evidential breath testing device ($59). Results are reviewed by a licensed Medical Review Officer (MRO) and reported within 24–48 hours.
Follow-Up Testing Program
After you pass your return-to-duty test, the SAP prescribes a follow-up testing schedule — a minimum of 6 unannounced tests in the first 12 months, with the possibility of testing for up to 60 months. The process includes an evaluation by a Substance Abuse Professional (SAP), completion of a recommended treatment or education program, a follow-up SAP evaluation, and passing a directly observed return-to-duty drug and/or alcohol test before being cleared to drive again.

A SAP is a qualified professional — such as a licensed physician, psychologist, social worker, or addiction counselor — who evaluates drivers who have violated DOT drug and alcohol regulations. The SAP determines the appropriate treatment or education program, monitors completion, and ultimately decides when the driver is eligible for return-to-duty testing. Your employer is required to provide you with a list of qualified SAPs in your area.
Yes. Per 49 CFR Part 40, all return-to-duty and follow-up drug tests must be conducted under direct observation. This means a same-gender observer will watch the specimen collection process. This requirement applies regardless of the type of violation that triggered the RTD process and cannot be waived.
The timeline varies depending on the SAP’s recommendations. Some drivers complete the process in a few weeks if the SAP recommends education only. Others may require months of treatment before being cleared. The key steps are: initial SAP evaluation, completing the prescribed treatment/education program, follow-up SAP evaluation, and then passing the return-to-duty test. However, you’ll be placed on a follow-up testing plan prescribed by the SAP — a minimum of 6 unannounced tests in the first 12 months, with testing potentially continuing for up to 60 months. All follow-up tests are also directly observed. Your employer must report the negative RTD test result to the FMCSA Clearinghouse.
Yes, but you’ll still need to pass a pre-employment drug test with the new employer. The good news is that a single DOT test can satisfy both the return-to-duty and pre-employment requirements — as long as it’s conducted as an RTD test under direct observation. The new employer must also conduct a full Clearinghouse query, which will show your violation history and RTD completion status.
