A DOT random drug testing program is an FMCSA requirement that ensures CDL drivers are tested for drugs and alcohol at unpredictable intervals throughout the year. Drivers are selected through a scientifically valid, computer-generated random selection process. Every driver in the testing pool has an equal chance of being selected each time, regardless of whether they were previously tested.
The FMCSA requires a minimum annual random drug testing rate of 50% and an alcohol testing rate of 10%, based on the average number of driver positions. This means that in a pool of 100 drivers, at least 50 drug tests and 10 alcohol tests must be conducted over the course of the year. Testing must be spread reasonably throughout the calendar year.
Yes. Since you cannot randomly select yourself for a drug test, owner-operators and single-driver companies are required by FMCSA regulations to join a drug testing consortium (also called a C/TPA or third-party administrator). The consortium creates a pool of drivers and handles random selections, scheduling, and compliance management. At Vertical Identity, our owner operator consortium starts at just $85 per year.
When you’re selected for a random test, you’ll be notified by Vertical Identity. You must report for testing promptly — there is no advance warning, and delaying or failing to report is treated the same as a refusal. We’ll schedule you at a convenient testing location near your zip code. Random drug tests can happen at any time during the year. Random alcohol tests may only be conducted while the driver is on duty, just before driving, or just after driving.
If you fail a random DOT drug or alcohol test, you are immediately removed from safety-sensitive duties and cannot drive a CMV. The violation is reported to the FMCSA Drug & Alcohol Clearinghouse. To drive again, you must complete the return-to-duty process, which includes evaluation by a Substance Abuse Professional (SAP), completing a treatment or education program, and passing a directly observed return-to-duty test.

Yes. In addition to random testing, FMCSA regulations require a pre-employment drug test before any CDL driver can operate a commercial vehicle. The pre-employment test is separate from the random testing pool. Other required testing categories include post-accident testing, reasonable suspicion testing, return-to-duty testing, and follow-up testing.
